BUYER’S AGREEMENT FOR ALL PUBLIC AUCTION VEHICLES

 

 

  • The State of California, Department of Motor Vehicles (DMV) regulations, states that the buyer is responsible for any and all past due and incurred registration fees.

 

  • The buyer must register the vehicle into his/her name, within five (5) days of the sale of the vehicle. Vehicle Code VC5602 and VC5900.

 

  • The buyer is responsible for all mechanical repairs, costs, and smog. The buyer is aware at the time of the sale that the vehicle is sold “AS IS”.

 

  • The Upland Police Department is not responsible for any omissions or errors in the description of vehicles being offered for sale. It shall be the bidder's responsibility to inspect and ensure the item is to their satisfaction concerning the details and condition of the item offered before purchasing. 
  • The buyer is informed all sales are final. NO REFUNDS WILL BE GIVEN, FOR ANY REASON.

 

The buyer acknowledges that the purchase of a vehicle at public auction is for their sole use, and is therefore subject to prosecution and penalties if in violation of Vehicle Code section VC12120. Specifically, only a licensed dealer, or the registered owner of record shall sell or offer for sale a vehicle.

 

Any violation of the above mentioned laws and vehicle code regulations, will result in arrest for unlicensed activity per Vehicle Code VC11700. Specifically, no person shall act as a dealer, without having first been issued a license as required by the Department of Motor Vehicles, section VC11701.


**PLEASE NOTE: STAFF WILL NOT BE AVAILABLE TO ASSIST BUYERS WITH LOADING OR REMOVAL OF VEHICLES, EQUIPMENT, ITEMS.**

Successful bidder will be responsible to provide all labor and equipment needed to safely remove. Vehicle Sales: City of Upland does not warrant conformity of vehicles to the requirements of the California Vehicle Code. Pursuant to California Vehicle Code 24007.5 notice is given that all buyers of vehicles must obtain a certificate of compliance for smog control devices prior to registration. The document certifies the vehicle complies with applicable Health and Safety Code requirements. Purchases by dealers and vehicles sold for dismantling or for exclusive off-highway use are exempt from this requirement. SALES TAX & REGISTRATION FEES, if applicable, is to be paid to DMV when registering the vehicle.

PayMac, receives and processes ALL payments for the "City" and will notify buyer of receipt of payment via email. NO CASH, CHECKS, OR MONEY ORDERS WILL BE ACCEPTED! Payment for an awarded item must be received within five (5) business days after notice of award of the winning bid.

The credit card limit per transaction is $4,000.00. For payments larger than this amount, follow the instructions listed under Wire Transfers.

The "City" may charge state/local sales tax, except for the purchase of on-road vehicles that will be registered and operated by the Buyer within the State of California. See Terms and Conditions for details on sales and smog-related responsibility.

A Buyers Premium of 10% will be added to the final sale price with a $1 minimum charge per auction for payment collections.

The successful bidder will be responsible for removal or pick-up of item(s) from the agency's premises and is responsible for packing, loading, shipping and/or transporting of items if necessary, and no later then 7 days after "notice of award".

Bid deposits may be required to ensure fairness to all buyers.
